Website Terms

These terms apply to portano.nl and to every page that falls under it, in Dutch and in English. They apply to everyone who opens the site: a restaurant owner, a guest, a supplier or someone just having a look.

They do not cover the ordering site and the ordering app we build for a restaurant, and they do not cover the portal where a restaurant manages its menu. The Platform Terms and the Terms and Conditions apply to those.

Which personal data we process when you visit this site or request a demo is set out in the Privacy Policy. What we do for accessibility and what is not finished yet is set out in Accessibility.

These terms are written in Dutch. There is an English version on the site as well. If the two differ, the Dutch text governs.

Portano supplies software. We build a restaurant an ordering site and an ordering app under that restaurant’s own name, with the menu, loyalty, email and SMS behind them, and a kitchen screen alongside. We build it. The restaurant cooks and sells.

The food is sold by the restaurant. If a guest orders from a restaurant that works with us, the agreement about that food is between that guest and that restaurant. Portano is not a party to it and not the seller.

The restaurant sets its own menu, its own prices, its own opening hours, its own delivery zones and its own delivery charges. We supply the tools the restaurant sets that with.

Portano does not deliver. We employ no drivers, we do not drive and we do not dispatch runs. A restaurant delivers with its own people, or does not deliver.

If you have a question about an order, a bill or the food itself, ask the restaurant. We cannot decide anything about that.

You may view and read this site, for yourself or for your restaurant. You may print or save a page to read again later, and you may share a link to a page.

That right is personal. You may not pass it on to anyone else and you may not charge for it.

A link to this site is fine, as long as that link does not suggest that you belong to Portano or that we endorse you, and as long as our page is not shown inside the frame of another site.

This right can be withdrawn. If you do not keep to article 5, we can withdraw it and refuse you access to the site.

Beyond that, these terms give you no rights to what is on the site. What we do not expressly allow is not allowed. If you want more, ask us at hello@portano.nl.

If you send us something, through the demo form, by email or by phone, you stay responsible for what you send. You warrant that you are allowed to send it, that it is correct and that you infringe nobody else’s right with it.

If it includes an idea, a suggestion or a point for improvement, that is not confidential. We may use it, work it out and build it into the product, without owing you anything for it and without naming you. If you do want to share something with us in confidence, agree that with us first.

If what you send contains personal data, we handle it as set out in the Privacy Policy. We keep a demo request for up to twelve months after our last contact, and sooner if you ask us to.

Do not send us data about your guests and do not send us passwords. The form is not for that, and we never ask for it.

We are not obliged to respond to every message, and we are not obliged to keep what you send. An ordinary question about our service we will of course answer.

The texts, the photographs, the design, the structure and the code of this site are ours, or the maker allows us to use them. The name Portano and the logo are ours.

You may not take that material, reproduce it or make it public. What article 4 allows is fine, and so is what the law allows you without our permission, such as the right of quotation.

If you want to use a text, a photograph or the logo somewhere else, ask us at hello@portano.nl. We give permission in writing, or we do not give it.

If you think material of yours is on this site without that being allowed, report it as set out in article 13. If you are right, we take it down.

This site sometimes carries links to other people’s sites, for example to a restaurant’s ordering site or to a source used in an article.

What is there is not ours and we do not manage it. We are not responsible for the content, not for the availability, and not for the way those sites handle your data. Their own terms and their own privacy policy apply there.

A link is a reference, not a recommendation. If you click through, you leave our site and these terms no longer apply there.

If a link no longer works, or leads to something that does not belong there, let us know at hello@portano.nl.

We do our best to keep this site reachable. We do not promise that it always works. Maintenance, a failure at the party that supplies our servers, a problem in the network or a mistake of our own can take the site offline for a while.

We may change this site. Pages can be added, move or disappear, and that can happen without notice.

What is on the site is correct at the moment we write it. Prices, features and texts can change afterwards. What you eventually agree with us is set out in your own agreement and not on this site.

If the site is temporarily unreachable, that changes nothing about an agreement you already have with us. This website is not part of the service we deliver to a restaurant.

What is on this site is information about what we build and what it costs. It is not legal, tax or financial advice, and not advice about your restaurant. Have a decision that touches money or contracts checked by someone who knows your situation.

We promise no result. We say what we do: we build your site and your app, we set up your menu, we write the pages and we run your campaigns. What that brings in depends on your restaurant, your menu, your guests and your market.

In particular we promise no place in a search engine. Where a restaurant appears in a search result is for the search engine itself to decide.

Examples, screens and figures on this site are there to explain something. They are not a commitment. The Disclaimer says more about this.

If someone else writes something about Portano, that is theirs. An estimate of our growth, an expectation of what you will turn over with us, a comparison or a test in a trade paper or on another site: we did not write it, we did not check it and it does not bind us. What we say is on this site and in your own agreement.

We take no responsibility for loss that arises because you rely on information on this site, or on something you reach through a link. What article 12 says about liability applies here in full, including the protection you keep as a consumer.

This site is what it is. You use it on that footing. We write the pages ourselves, we check them and we keep them up to date, but we give no guarantee about what is on them or about how the site performs. What we do stand behind is set out in 11.5.

In particular, we give no guarantee that this site:

• is reachable at every moment, or that a failure is over within a set time
• is complete: we do not describe every feature, every exception and every case
• is current: a price, a feature or a text can lag behind what we actually do at that moment
• is free of error: a typo, a wrong number or a page that does not load properly happens
• works the same in every browser, on every screen and with every assistive tool
• is free of harmful code, so keep the security of your own device in order

We give no guarantee that a page is suitable for the decision you want to take. If you read our prices and switch to us on the strength of that, or cancel something else because of this site, that choice is yours. What you agree with us is set out in your own agreement. Article 9.3 says that too.

We give no guarantee about anything you reach through a link on this site. What is there, who manages it, whether it is correct and whether it is still there tomorrow, we do not know. Article 8 says more about this.

What we do stand behind: something that is wrong we put right as soon as we know about it.

This article is about this website. What we promise a restaurant as a service is set out in the Terms and Conditions. What a guest may expect when ordering is set out in the Platform Terms. This article takes nothing away from either.

If you are a consumer, your statutory rights continue to apply in full. An exclusion in this article cannot take those rights away.

This site is informative and you can read it free of charge. We are not liable for damage that arises because the site is temporarily down, because information is out of date or incomplete, or because a link to another site is no longer correct.

Nor are we liable for consequential loss, lost turnover, missed savings or loss of data through the use of this site.

These limits do not apply if the damage is the result of intent or deliberate recklessness on our part. Then we are simply liable.

We never exclude and never limit liability for death or personal injury.

If you are a consumer, the rights the law gives you continue to apply in full. Nothing in this article affects them.

Our liability for the service itself is not set out here. For a restaurant it is set out in the Terms and Conditions, for a guest who orders in the Platform Terms.

If you see something on this site that you believe is not allowed, mail hello@portano.nl. That goes for content that infringes a right of yours or of someone else, for content that breaks the law, and for anything that is factually wrong.

In your report, say which page it concerns, which part it concerns, why you believe it is not allowed, and how we can reach you. The more concrete your report, the faster we can act on it.

We confirm your report within one working day. After that we assess it and let you know what we are doing. If the content is indeed unlawful, we take it down or change it.

Sometimes we need more from you to judge what is going on. Then we ask for it and wait for your answer.

If you disagree with what we decide, you can put the matter to a court. Article 15 says which court that is.

We may change these terms, for example if the site changes or if the law calls for it.

The version on this page at the moment of your visit is the version that applies. The top of the page says when we last updated it.

A change here changes nothing about the agreement you have with us as a restaurant. The Terms and Conditions and the arrangements set out in them apply to that.

Dutch law applies to these terms and to the use of this site.

If we cannot work it out together, we put the dispute to the Rechtbank Rotterdam, the district court in Rotterdam. That is the court of the district where Portano is registered.

If you are a consumer, you keep the right to put your case to the court the law assigns you. What 15.2 says does not take that right away.

Before it comes to that, we would rather hear it from you first. We always try to work it out together first.
